Terms of service for pool cleaning and maintenance.

1. Agreement to terms

These terms and conditions (“Terms”) govern the use of the website and the supply of pool cleaning, maintenance and related services by The A-Team Solutions LLC (“we”, “us”, “our”), trading as The Pool Cleaners. This website (thepoolcleaners.co.za) is operated by The A-Team Solutions LLC under the brand name The Pool Cleaners. By using our website, requesting a quote or booking a service, you agree to be bound by these Terms. If you do not agree, please do not use our services or website.

2. Our services

We provide pool cleaning, maintenance, chemical balancing, repairs and related services as described on our website and in any quote or service agreement. Services are offered in the areas we serve (Cape Town area, CBD, Green Point, Sea Point, Waterfront, Camps Bay, Bantry Bay) and are subject to availability and our acceptance of your quote request.

Specific scope, frequency and pricing will be set out in your quote or service agreement and may vary by pool type, condition and location.

3. Quotes and booking

  • Quotes are valid for the period stated on the quote (or, if not stated, a reasonable period as communicated by us) and are subject to our confirmation.
  • Service is confirmed only when we have accepted your quote request and you have accepted our quote and any payment or deposit terms.
  • You must provide accurate contact details, address, pool access and any relevant information (e.g. pool type, pets, gate codes) so we can perform the service safely and on schedule.
  • You are responsible for ensuring safe and clear access to the pool area at the agreed date and time. If we cannot access the pool, we may charge for the visit or reschedule at your cost as set out in our cancellation policy.

4. Payment

Payment terms will be set out in your quote or invoice. Unless otherwise agreed:

  • Payment is due as specified (e.g. on invoice, after each visit, or on a recurring basis).
  • We may require a deposit or advance payment for new customers or one-off services.
  • We accept the payment methods we specify (e.g. EFT, card). You must pay in the currency and manner we indicate.
  • Late payment may result in interest, suspension of service and recovery action. You remain liable for all amounts due.

5. Cancellation and rescheduling

If you need to cancel or reschedule a scheduled visit:

  • Please notify us as soon as possible. We may require a minimum notice period (e.g. 24–48 hours) to avoid a cancellation or no-access fee.
  • If we arrive and cannot access the pool or property through no fault of ours, we may charge for the scheduled visit.
  • For ongoing contracts, cancellation of the contract may be subject to the terms set out in your service agreement (e.g. notice period).

We reserve the right to cancel or reschedule in cases of weather, safety, illness or other reasonable cause. We will try to give you notice and to reschedule where possible.

6. Your responsibilities

You agree to:

  • Provide safe, clear access to the pool and any equipment we need to service.
  • Inform us of any hazards, pets, access codes or special instructions before the visit.
  • Ensure that the pool and equipment are in a condition that allows us to perform the service safely (e.g. no dangerous damage or unauthorised modifications).
  • Use the pool and equipment in accordance with any instructions or advice we give and to notify us promptly of any problems.

7. Limitation of liability

To the fullest extent permitted by law:

  • We provide services with reasonable skill and care. We are not liable for loss or damage caused by factors outside our control (e.g. extreme weather, pre-existing equipment failure, misuse or neglect of the pool or equipment after our visit).
  • Our total liability to you for any claim arising from or in connection with our services or these Terms shall not exceed the amount you have paid us for the relevant service(s) in the twelve (12) months preceding the claim, or such other limit as may be set out in your service agreement.
  • We are not liable for any indirect, consequential or special loss (e.g. loss of profit, business or data), whether or not we were advised of the possibility.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.

8. Warranty and complaints

If you are not satisfied with a service, please tell us as soon as reasonably possible. We will investigate and, where appropriate, re-perform the service or otherwise resolve the matter in good faith. Any warranty or guarantee we give will be set out in your quote or service agreement and is in addition to your statutory rights.

9. Use of website

You may use our website only for lawful purposes and in accordance with these Terms. You must not use it to transmit harmful, offensive or illegal content, to attempt to gain unauthorised access to our or others’ systems, or to interfere with the site’s operation. We may suspend or restrict access to the website at any time without liability.

10. Intellectual property

All content on this website (including text, logos, images and design) is owned by or licensed to The A-Team Solutions LLC (trading as The Pool Cleaners). You may not copy, modify or use it for commercial purposes without our prior written consent.

11. Privacy

Your use of our services and website is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information.

12. Changes

We may update these Terms from time to time. The “Last updated” date at the top will be revised when changes are made. Continued use of our website or services after changes constitutes acceptance of the updated Terms where permitted by law. For ongoing contracts, we will notify you of material changes where required by your agreement or by law.

13. General

  • If any part of these Terms is held to be invalid or unenforceable, the rest remains in effect.
  • Our failure to enforce a right does not waive that right.
  • These Terms are governed by the laws of the jurisdiction in which we operate (e.g. the laws of South Africa). Any dispute shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, unless otherwise required by law.
